A procedure by which one party seeks to persuade the court that there is no genuine issue or controversy regarding material facts, and accordingly, that the party filing the motion is entitled to prevail as a matter of law.  For example, if a motion for summary judgment by the Plaintiff is granted by the judge on the issue of fault, then the Defendant becomes responsible for any and all damages that are proved by the Plaintiff.
